General terms and conditions
At our Soliva residence, 7515 Sils Baselgia, we offer tastefully furnished holiday apartments of various sizes in one of the most beautiful locations on the plain between Sils Maria and Sils Baselgia. They boast a uniquely beautiful, unobstructed view towards Lake Sils, the Fextal valley and Piz Margna. The old farmhouse, dating from 1905, was completely renovated in 1999 and is furnished with great taste and comfort.
The rental charge for the Soliva Residence comprises the total amount of the agreed rent plus the ancillary costs listed on the confirmation/invoice.
Prices and additional costs:
The rental prices stated in the tenancy agreement are binding. We reserve the right to adjust prices for reasons beyond our control (e.g. currency fluctuations, newly introduced or increased taxes). The rental properties may be occupied by no more than the number of people corresponding to the number of beds specified in the contract. Additional ancillary costs and services used will be charged at the latest upon departure.
Cancellation of the tenancy agreement:
- Cancellations made up to 60 days before the start of the tenancy are free of charge.
- In the event of a cancellation from the 59th day prior to the start of the rental period, the tenant is generally liable to pay the landlord 100% of the confirmed price.
- If the apartment can be fully re-let following a cancellation, the landlord (Residenz Soliva) is obliged to refund the deposit paid by the customer.
- If the apartment can only be re-let for part of the period, Residenz Soliva is entitled to offset the outstanding amount in full.
- It is advisable for the tenant to take out cancellation insurance.
Terms of payment:
Residenz Soliva will issue a booking confirmation, which also serves as an invoice. The rent, including service charges, is to be paid as follows:
- 1/3 of the total rental price is payable upon signing the contract into our bank account with GKB
- The remaining balance must be paid on site in cash or by Maestro card by the end of the rental period at the latest.
- For bookings made less than 15 days before the start of the rental period, the full amount must be paid on site by the end of the rental period.
- A booking is confirmed upon receipt of the deposit or payment.

Complaints:
Should any shortcomings be demonstrably present, and provided that the defects cannot be rectified on site, Residenz Soliva must be notified immediately by telephone (tel. 081 826 58 80). Only in this way can all necessary steps be taken to remedy the breach of contract or to provide equivalent accommodation. If the holiday guest does not make use of their booked accommodation or the equivalent alternative proposed by us, no refund will be made by us. Likewise, any liability is excluded in such cases. We expressly point out that we can only consider complaints or any claims if notified within 48 hours of using the service. Furthermore, these claims must be submitted in writing directly to Residenz Soliva within 10 days of the end of the stay; otherwise, any claim for compensation shall lapse. Under no circumstances shall the claim for compensation exceed the amount of the rental fee. Should no agreement be reached, the place of jurisdiction shall be Maloja.
Force majeure:
During the holiday season, exceptional circumstances beyond our control may arise from time to time. Should force majeure, environmental disasters or acts of God prevent us from carrying out our letting activities, we are entitled to cancel the booking without compensation. If other reasons, for which we are also not responsible, prevent us from providing the service, we may either accommodate you in another holiday flat or, if necessary, cancel the booking. In this case, you will be refunded the amount paid, but you waive any further claims.
Liability:
Residenz Soliva is responsible for ensuring that bookings are processed correctly on site. However, Residenz Soliva cannot be held liable for unforeseeable circumstances beyond its control, such as:
- Failures or disruptions to the water and/or electricity supply, heating, etc.
- Reduction in the rental value as a result of environmental damage or temporary increases in noise levels, such as traffic diversions, building sites, etc.
- The tenant must bear the full cost of any damage that can be proven to have been caused by them during their stay.
